I’m looking to see if anyone has drafted a resolution appointing an agent to act on behalf of the jurisdiction with regard to FEMA-4092-VA-DR, Hurricane Sandy.

Hi Jennifer,

Our locality appointed an agent at the time that they confirmed the declaration of a local disaster right after Hurricane Sandy. Our locality has worked through quite a few FEMA grants due to our location and wanted to avoid having to go back through the resolution process a second time for Sandy. The resolution is below - hope it helps!

A RESOLUTION TO CONFIRM AND CONSENT TO THE DECLARATION OF A LOCAL DISASTER AND TO DESIGNATE AN AGENT AS REQUIRED FOR PUBLIC ASSISTANCE PURPOSES

WHEREAS, the Board of Supervisors of Gloucester County does hereby find that due to the projected impact of Hurricane Sandy, Gloucester County faced a condition of extreme peril which necessitated the County Administrator, Brenda Garton, acting as Director of Emergency Management, to declare a local emergency at 1:00 p.m. on October 26, 2012, in order to provide preparedness, response, and recovery, and other activities to protect life and property; and

WHEREAS, the Board desires that all further emergency actions authorized by law may be taken by the County Administrator, as the Director of Emergency Management, or in her absence, by the Deputy Director of Emergency Management; and

WHEREAS, assistance may be available for costs associated with this declaration from Federal and State sources; and

WHEREAS, in order to apply for assistance from FEMA, FEMA requires the Board of Supervisors to designate an Agent to make application for such assistance.

NOW, THEREFORE, BE IT RESOLVED by the Gloucester County Board of Supervisors this 7th day of November 2012, that the act of the County Administrator, as the Director of Emergency Management, in declaring a local emergency is hereby consented to and confirmed, as are all actions set forth above pursuant to that declaration;

BE IT FURTHER RESOLVED by the Gloucester County Board of Supervisors that Brenda Garton, County Administrator, acting in her capacity as Director of Emergency Management, is hereby designated as Gloucester County’s agent for the purposes of seeking public assistance, including but not limited to any assistance which may be available from or through FEMA; and

BE IT FURTHER RESOLVED by the Gloucester County Board of Supervisors that Brenda Garton, County Administrator, acting in her capacity as Director of Emergency Management, is hereby directed to seek whatever assistance may be available from Federal and State sources for costs associated with this declaration.
