You should look at the Fair Labor Standards Act. If a person is paid by the same entity, then when they go beyond 40 hours, they are usually eligible for overtime - regardless of whether it's two different jobs. Not sure if being an elected official makes a difference. Recommend checking with your town attorney.

Wouldn't serving as an employee and as a member of the council be an inherent conflict?
